General Meeting

May 10, 2007

Call to Order: A general meeting of the Gustavus City Council was held on May 10, 2007 at 7:00PM at City Hall.

Mayor Marchbanks called the meeting to order at 7:00PM

Roll Call:

Comprising a quorum of the Council the following were present –

Councilmember Atkins

Councilmember Heacox

Vice Mayor Howell

Councilmember King

Councilmember Klawunder

Councilmember Nixon

Addition to Agenda: None

Reading & Approval of Minutes:

A motion was made by Councilmember Klawunder to accept the minutes with change.  Motion was seconded by Councilmember Heacox.

Roll Call Vote – 7/0

Ordinances for Public Hearing:

·        Publication of revised Title 4 Revenue and Finance- Mayor Marchbanks gave comment on how this ordinance had come about and what changes had occurred.  The Mayor discussed that the revised Title 4 would be out for 30 days. 

·        Title 10 Land Acquisition and Disposal Ordinance-Mayor Marchbanks gave comment on how and why this ordinance had come about and where most of the wording had come from.  The Mayor explained that they would be going through the ordinance and taking questions and comments.  Questions and comments followed.  It was stated that the Council would work on this at the next work session and bring forward at the June General Meeting.

·        Non-Code Ordinance 2007-06NCO An ordinance for the City of Gustavus providing for the amendment of the budget for FY07- 

Mayor Marchbanks read the ordinance.  Councilmember Klawunder explained why there was the need for this ordinance.  Councilmember Howell made the motion “I move that we adopt ordinance number 2007-06NCO as presented with one change that Lands Selection Committee be changed to Land Committee”.  Seconded by Councilmember Klawunder.

·        Non-Code Ordinance 2007-04NCO An ordinance for the City of Gustavus providing for the amendment of the budget for FY07 –

Questions were answered on 2007-04NCO.  Councilmember Klawunder motioned “I move that we adopt  2007-04NCO”.  Seconded by Councilmember King.

·        Non-Code Ordinance 2007-05NCO An ordinance for the City of Gustavus providing for the amendment of the budget for FY07 –

Councilmember King motioned “I move that we accept ordinance number 2007-05NCO.”  Seconded by Councilmember Klawunder.

Committee Reports:

New Business: 

·        Reports by committee that went to the Borough Meeting on May 3, 2007 –

Mayor Marchbanks explained about the meeting and the group that had traveled to Juneau to participate in that meeting.  The group consisted of Councilmember Klawunder, Mr. Greg Streveler, Mr. Dan Zobrist, and Ms. Janet Lassiter.  The group members gave reports and discussed their opinions of the meeting.  Discussion and questions followed.

·        Certification of Petition on Local Option Vote-

The clerk stated that a petition had been certified.

Mayor Marchbanks turned the meeting over to Vice Mayor Howell.  Vice Mayor Howell said that since a petition initiated by citizens had been certified the council was in the position of getting it to the residents to vote on.  He read the petition/ballot question.  Vice-Mayor Howell explained that what the council was doing at this meeting was only to put the question on the ballot, not about if there is a package liquor store in

Gustavus; that will be decided by the Gustavus Voters.  He talked about previous conflict of interest hearings, and determination of significant financial interest.  He stated that the council needed to make clear that there was no conflict when voting. 

 Vice Mayor Howell proceeded to ask Mayor Marchbanks conflict of interest questions to which she answered all questions asked.   She stated she did not think she had a conflict of interest.  Vice Mayor Howell declared Mayor Marchbanks did not have a conflict of interest and should participate in the vote.  No councilmember’s voiced opposition to the ruling. 

Vice Mayor Howell asked Councilmember Atkins conflict of interest questions to which he answered all questions.  Councilmember Atkins stated he did not feel he had a conflict.  Vice Mayor Howell declared Councilmember Atkins did not have a conflict of interest and should participate in the vote.  No councilmember’s voiced opposition to the ruling. 

The meeting was turned over to Mayor Marchbanks.

·        Motion by the Council on Certification on Local Option Vote-

Discussion and questions on City Ordinance and State Statute followed.  Vice Mayor Howell made the motion “that we adopt Resolution 2007-06A”.  Seconded by Councilmember Klawunder.    Further discussion followed. 

Roll Call Vote 7/0

·        Motion to let contract for less than $5000.00 for Scope of Service on gravel pit clearing-

Councilmember Klawunder made the motion “I move the City of Gustavus offer City Gravel Pit Preparation Project contract and Scope of Services to Mr. Kenneth Marchbanks for the total compensation sum of $4999.00 with work to be completed on or before the 1^st day of June, 2007”.  Seconded by Councilmember Atkins.  Councilmember Klawunder gave a map of the work area in the gravel pit.  He showed the area where the work would be done and explained why this is being done.  Vice Mayor Howell asked what was the process for giving this project to Glacier Bay Construction and if this was being done per ordinance.  Councilmember Klawunder explained the process and confirmed it was being done per ordinance.  Discussion followed on the project.  Mayor Marchbanks recused herself from participating and voting, and turned the meeting over to Vice Mayor Howell. 

Roll Call Vote 6/0 with Mayor Marchbanks abstaining. 

Vice Mayor Howell turned the meeting over to Mayor Marchbanks.

Public Comment on Non-Agenda Items:  None

City Council Comments:

·        Councilmember Klawunder gave comment that the CRMA is in the process of being amended.  He discussed why this was occurring and described the culvert/bridge project.

·        Mayor Marchbanks announced Lauri Ross as Vice-Chair of the Marine Facilities.

·        Mayor Marchbanks announced Diane Klawunder as Grant Administrator, and that she is doing this without pay.  She asked the council if they would like to vote on this.  The council declined.

·        Mayor Marchbanks announced John Barry’s leave of absence from the DRC Committee.

·        Mayor Marchbanks gave comment on the school talent show and the community support of kids.

·        Mayor Marchbanks gave comment that VMI would not be here until July.

·        Vice Mayor Howell and Councilmember Heacox gave comments on the erosion/bank stabilization meeting with DNR that had occurred. 

Executive Session:  None

 With no further business before the council, the meeting adjourned at 9:16PM.
