City Council General Meeting

October 9, 2008

 

 

Call to Order:  A General Meeting of the Gustavus City Council was held on October 9, 2008 at 7:00PM.

Mayor Klawunder called the meeting to order at 7:00PM.

 

 

Roll Call:

Comprising a quorum of the Council the following were present:

                             Mayor Klawunder

                             Vice Mayor Marchbanks

                             Council Member Atkins

                             Council Member Berry

                             Council Member Nixon

                             Council Member Unkel

 

Council Members not in attendance:

                             Council Member Howell          -Absent

 

Reading & Approval of Minutes

Minutes from the September 11, 2008 General Meeting were read by the City Clerk.

 

 

 

Mayor’s Request For Agenda Changes:

 

§    Request that Item 8a Non Code Ordinance 2008-23NCO be moved to after 12a. 

 

Committee Reports:

§    Planning Committee report given by Carolyn Edelman.

 

Consent Agenda:

          1.  Accept the appointment of:

                   John Nixon as member of the Marine Facilities Committee.

                   Bill Unkel as a liaison of GVFD.

          2.  Accept resignation of:

                   Ken Klawunder from the Land Committee and the Finance

                   Committee.

 

 

 

Ordinances for Publication:

§   2008-26NCO An Ordinance for the City of Gustavus providing for the amendment of the Gustavus Administration Budget for Fiscal Year 2009.

Public Comment:  None

 

 

 

 

§   2008-27  An Ordinance for the City of Gustavus amending Title 2.20.090.

 

Public Comment:  None

 

 

 

Ordinances for Public Hearing:

§   2008-23NCO An Ordinance for the City of Gustavus providing for the amendment of the Administration Budget for Fiscal Year 2009.

 

(Clerk’s Note:  2008-23NCO was moved during the Mayor’s request for agenda changes.)

 

§   2008-24NCO An Ordinance for the City of Gustavus providing for the amendment of the Marine Facilities Budget for Fiscal Year 2009.

 

Ordinance 2008-24NCO was read by Council Member Nixon.

 

Public Hearing:  There being no one who wished to be heard the Public

                           Hearing was closed. 

 

 

CONFLICT OF INTEREST:               Council Member Berry asked to be  

                                                        recused due to the fact that he is an

                                                        employee that has done the

                                                        inspections in the past. 

 

RULING:                                          Mayor Klawunder ruled that Council

                                                        Member Berry should be recused

                                                        from voting. 

 

 

Resolutions:

§   Resolution 2008-18 A Resolution by the City of Gustavus to investigate avenues of City funding support for Gustavus Community Clinic. 

 

Resolution 2008-18 was read by Council Member Atkins. 

Public Comment:

                                      Diane Klawunder

                                      Lois Nixon

 

 

CONFLICT OF INTEREST:                 Vice Mayor Marchbanks declared a

                                                          conflict of interest due to the fact

                                                         that her daughter-in-law is

                                                          employed at the Clinic.

RULING:                                            Mayor Klawunder ruled that she

                                                          should not vote. 

 

Council discussion on agenda item followed.

 

 

 

 

 

§   Resolution 2008-19  A Resolution supporting the Gustavus

Community Clinic’s application to the Rasmusson Foundation for

grant funding of Clinic improvements and equipment upgrades. 

 

Resolution 2008-19 was read by Council Member Unkel.

Policy & Procedures for Publication:

§    Policy – Liquor License Consideration Policy and Procedure for the City of Gustavus.

 

Public Comment:  None

 

 

 

Policy & Procedures for Public Hearing:  None

 

Unfinished Business:

 

§   Accept an amendment to the Memorandum of Agreement between the Department of Transportation & Public Facilities and the City Gustavus for Design and Construction Services for the Drainage Improvements – Rink Creek Road at the Gravel Pit Intersection. 

 

Public Comment:  None

 

 

CONFLICT OF INTEREST:                 Vice Mayor Marchbanks declared a

                                                          conflict of interest due to the fact

                                                          that her company may bid on the

                                                          project.

 

RULING:                                            Mayor Klawunder ruled that the

                                                          Vice Mayor should be recused.

 

 

§   2008-23NCO An Ordinance for the City of Gustavus providing for the amendment of the Road Committee and Administration Budget for FY09. 

 

Council Member Unkel read 2008-23NCO.

 

Public Comment:  None

 

 

CONFLICT OF INTEREST:                 Vice Mayor Marchbanks declared a

                                                          conflict of interest because her

                                                          company may be bidding on the                                                                 project. 

 

 

RULING:                                            Mayor Klawunder ruled that Vice

                                                          Mayor Marchbanks does have a

                                                          conflict and should not vote.

 

 

New Business:

§   Sending one person to attend the Tongass Futures Roundtable- Southeast Wood Energy Conference

Public Comment:  None

§   Acceptance of Snow Contract Bid with Miller Construction

 

 

 

§   Acceptance of RFQ RC 2009-03 Grave Pit Expansion

 

 

CONFLICT OF INTEREST:                 Vice Mayor Marchbanks declared

                                                          a conflict due to the possibility of

                                                          being a potential bidder.

 

RULING:                                            Mayor Klawunder ruled a conflict

                                                          does exist.

§   Council Member Nixon commented on the testing being done on the 15^th on Tract B

§ Becky King thanked the 2 Council Members whose terms are     completed.
