City Council General Meeting

May 8, 2008

 

 

Call to Order:  A General Meeting of the Gustavus City Council was held on May 8, 2008 at 7:00PM.

 

Roll Call:

Comprising a quorum of the Council the following were present:

                             Mayor Klawunder

                             Vice Mayor Marchbanks

                             Council Member Atkins

                             Council Member Berry

                             Council Member Howell

                             Council Member Nixon

                             Council Member Unkel

 

 

Reading & Approval of Minutes

Minutes from the April 10, 2008 General Meeting were read by the City Clerk.

 

 

 

Mayor’s Request For Agenda Changes:

 

§     Borough Special committee will be giving a committee report

§    Resolutions will be given for each of the Policies and Procedures that have a Public Hearing tonight.

§    At the end of consent agenda there will be a presentation by

        Mike Taylor.

 

Committee Reports:

§    GCN Committee report given by Council Member Berry.

§    Endowment Fund Committee report given by Bruce Tedtsen.

§    Marine Facilities Committee report given by Diane Klawunder.

§    Borough Special Committee report given by Bruce Tedtsen.

Presentation-

§    Mike Taylor presented the Council with a $500.00 check from BP as a donation to the DRC.

Ordinances for Publication:

§    2008-09NCO  An Ordinance for the City of Gustavus providing for the amendment of the Marine Facilities budget for fiscal year 2008.

 

Council Member Nixon gave a description of the agenda item.

§    2008-10NCO  An Ordinance for the City of Gustavus providing for the amendment of the Gustavus Library budget for fiscal year 2008.

 

Vice Mayor Marchbanks explained the non code ordinance.

Public Comment:  None

 

 

 

§    2008-11NCO  An Ordinance for the City of Gustavus providing for the amendment of the Road budget for fiscal year 2008.

 

Council Member Unkel gave explanation.

Public Comment.  None

 

 

 

§    2008-12NCO  An Ordinance for the City of Gustavus providing for the amendment of the Administration budget for fiscal year 2008.

 

The City Clerk gave an explanation of the amendment.

Public Comment:  None

 

 

 

§    2008-13NCO  An Ordinance for the City of Gustavus providing for the amendment of the Parks & Rec budget for fiscal year 2008.

 

Council Member Berry gave an explanation that this is to encumber the money from previous years T-Shirt sales.

Public comment: None

 

 

 

Vice Mayor Marchbanks made a statement the T-Shirt money still exists and that as soon as there is a project for it that it will be used for that.

Mayor Klawunder stated that the funds are not going into the general fund. 

 

§    2008-14NCO  An Ordinance for the City of Gustavus providing for the establishment and adoption of the budget for fiscal year 2009.

 

Council Member Unkel gave an explanation of 2008-14NCO.

Public Comment: None

 

CONFLICT OF INTEREST:                 Council Member Berry-

Council Member Berry stated that he is a City employee and he has a substantial financial interest in one of the budget categories within the Cities FY09 budget, specifically the DRC wages budget category and asked to be recused from the vote to publish and also the vote to adopt. 

 

RULING:                                            Mayor Klawunder ruled that because his wages are involved that he does have a conflict.

 

REQUEST TO OVERRIDE:                 Council Member Howell

§    2008-06NCO  An Ordinance for the City of Gustavus providing for the amendment of the DRC budget for fiscal year 2008.

 

Council Member Berry explained the non code ordinance and the amendment.

 

Ordinance 2008-06NCO was read by Council Member Unkel.

 

Public Hearing:

There being no one who wished to be heard the public hearing was closed.

 

 

 

 

 

§    2008-07NCO  An Ordinance for the City of Gustavus providing for the amendment of the Roads budget for fiscal year 2008.

 

Council Member Nixon explained the non code ordinance.

 

Ordinance 2008-07NCO was read by Council Member Nixon.

 

Public Hearing:              There being no one who wished to be heard the public hearing was closed.

 

 

 

 

 

§    2008-08NCO  An Ordinance for the City of Gustavus providing for the amendment of the Gustavus Volunteer Fire Department budget for fiscal year 2008.

 

Ordinance 2008-08NCO was read by Council Member Atkins.

 

Public Hearing:    There being no one who wished to be heard the public                                       hearing was closed.

 

 

 

 

 

 

 

Resolutions:

§    Resolution 2008-05  A resolution by the City of Gustavus Council supporting the application for an Alcohol Beverage Control Special Events Permit for the Gustavus Ladies Golf Tournament. 

 

Resolution 2008-05 was read by Vice Mayor Marchbanks.

§    Resolution 2008-06  A resolution by the City of Gustavus Council setting a Special Election date of July 8, 2008.

§    Resolution 2008-07  A resolution by the City of Gustavus Council creating a Special Advisory Committee called Sales Tax Review Committee. 

Resolution 2008-07 was read by Council Member Unkel.

Motion to Amend: Council Member Howell moved to amend the title of

the Resolution to read “A resolution by the Gustavus City Council creating a special Committee called the Fish Box Tax Implementation Committee”.

Council Member Howell gave an explanation and read portions of the policy and procedure.

§    Resolution 2008-08  A resolution by the City of Gustavus Council to adopt the document “Salmon River Harbor Policy and Procedures”. 

 

Resolution 2008-08 was read by Council Member Howell.

Mayor’s Report:

§     DOT meeting that was to be held on the 19^th of May has been postponed.

§   DCCED Survey results meeting will be on July 16^th at the school.

§   Council Member Howell commented regarding the budget and the accomplishments of the City.

§   Council Member Unkel stated that there would be an open position on the Road Committee and possible change of chair.
